Experience
- Providing strategic advice to clients in protecting their intellectual property rights including trademark, copyright, design, patent, domain name in Hong Kong and other jurisdictions
- Representing local and multinational clients including Fortune Global 500 companies to manage their intellectual property portfolios including securing trademark, registered design and patent applications, maintaining and/or restoring trademark, registered design and patent registration s in Hong Kong and other jurisdictions
- Representing international notable and multinational clients such as automotive manufacturers, hotels, fashion groups, insurance company, telecommunication companies, watchmakers, food and skin care manufacturers, land developer and spa provider as well as pharmaceutical company in overcoming office action of trademark applications and commencing/defending oppositions, invalidation actions, cancellation actions, non-use cancellation actions against the trademark applications/trademark registrations in Hong Kong and other jurisdictions
- Representing clients in bringing and defending court actions in relation to various intellectual property disputes, including trademarks, tradenames, passing off, copyrights, registered designs and IP rights’ ownership and licensing of the IP rights. Represented a governmental department in Hong Kong in a passing off action, a quasi-governmental department in a certification mark infringement and passing off action and a reputed South Korean skincare listed company in numerous passing off, trademark and copyright infringement actions against infringers and successfully obtained judgements against the infringers inclusive of the relief of the permanent injunction, damages and costs. Represented a renowned South Korean skincare company in successfully defending an interlocutory injunction action about its use of marks
- Representing clients to file complaints against shadow companies with the Companies Registrar and to handle striking out actions against those companies
- Assisting clients to lodge complaints with Hong Kong Customs & Excise Department regarding counterfeits as well as handling the related matters
- Representing clients to commence action in the Domain Name Dispute Resolution Centre regarding disputes of domain names
- Advising, drafting and reviewing IP related commercial agreements including assignments of intellectual property rights, technology transfer agreements, licensing agreements, franchise agreements, collaboration agreements, research and development agreements, distribution agreements, non-disclosure agreement, deed of indemnity
- Conducting IP due diligence search in connection with IPO and the merger and acquisition and providing relevant legal opinion.
